1. IRREVOCABLE ACCEPTANCE OF LEGALLY BINDING TERMS
By accessing, downloading, installing, registering for, or utilizing any aspect, feature, or functionality of the WebSimHost Virtual SIM and Telephony Services (collectively, the "Services"), you, the individual or entity accessing the Services (hereinafter referred to as "You," "Your," "User," or "Customer"), hereby explicitly acknowledge, comprehend, and irrevocably agree to be legally bound by the entirety of these Terms of Service ("Terms" or "Agreement"). Your act of creating an account, clicking "I Agree," submitting payment, or initiating any use of the Services constitutes your unequivocal, complete, and unconditional acceptance of these Terms, all incorporated policies (including Privacy Policy and Acceptable Use Policy), and any subsequent amendments enacted by WebSimHost. If You do not unconditionally agree to each and every provision, clause, and stipulation contained herein, You are expressly and categorically prohibited from accessing, installing, or using the Services in any manner whatsoever. Continued use following any modification to these Terms constitutes acceptance of those changes.

2. COMPREHENSIVE DESCRIPTION OF SERVICE OFFERINGS AND "AS IS" NATURE
WebSimHost provides a digital platform for virtual SIM and telephony services, including but not limited to: provisioning of virtual telephone numbers, SMS/MMS reception and sending capabilities, call forwarding, voicemail services, and API integrations (the "Services"). These Services are software-based, network-dependent, and rely on third-party telecommunications carriers and infrastructure. WebSimHost explicitly declares that all Services are provided on a strictly "AS AVAILABLE," "AS IS," and "WITH ALL FAULTS" basis. The Company reserves the sole, absolute, and unrestricted right to modify, update, alter, enhance, limit, degrade, suspend, or permanently discontinue any Service, feature, functionality, pricing plan, or geographic availability at any time, for any reason or no reason, without prior notice, explanation, obligation, or liability to any User. All descriptions of Services, including technical specifications, uptime percentages, and supported countries, are for general informational purposes only and do NOT constitute a warranty, guarantee, service level agreement (SLA), or binding promise of performance.

3. ABSOLUTE DISCLAIMER OF ALL WARRANTIES AND LIABILITY FOR FUNCTIONALITY
3.1. ZERO GUARANTEES OF SERVICE OPERABILITY OR SUCCESSFUL VERIFICATION: WEBSIMHOST EXPLICITLY, COMPLETELY, AND UNCONDITIONALLY DISCLAIMS ANY AND ALL WARRANTIES, REPRESENTATIONS, COVENANTS, OR GUARANTEES—WHETHER EXPRESS, IMPLIED, STATUTORY, OR ARISING FROM COURSE OF DEALING OR TRADE USAGE—REGARDING THE RELIABILITY, AVAILABILITY, ACCURACY, TIMELINESS, QUALITY, SUITABILITY, OR FUNCTIONALITY OF THE SERVICES. SPECIFICALLY, WEBSIMHOST DOES NOT AND CANNOT GUARANTEE THAT ANY PROVIDED VIRTUAL NUMBER WILL: (A) SUCCESSFULLY RECEIVE INBOUND SMS, MMS, OR VOICE CALLS; (B) BE ACCEPTED BY ANY THIRD-PARTY WEBSITE, APPLICATION, OR SERVICE FOR VERIFICATION PURPOSES; (C) REMAIN ACTIVE FOR ANY SPECIFIC DURATION; OR (D) BE FREE FROM CARRIER FILTERING, BLOCKING, OR RECYCLING. SERVICE IS SUBJECT TO NUMEROUS UNCONTROLLABLE FACTORS INCLUDING NETWORK CONGESTION, CARRIER POLICIES, REGULATORY CHANGES, AND THIRD-PARTY INFRASTRUCTURE FAILURES.

3.2. USER ASSUMPTION OF ALL RISKS AND WAIVER OF CLAIMS: You hereby acknowledge, accept, and assume ALL risks associated with the use of the Services. WebSimHost, its affiliates, directors, officers, employees, agents, partners, licensors, and suppliers shall bear ZERO liability for any loss, damage, harm, expense, or inconvenience—whether direct, indirect, incidental, special, consequential, or punitive—arising from or related to: failed or missed calls; undelivered, delayed, misdirected, or lost messages; network unavailability; carrier rejection; number revocation or deactivation; service degradation; security incidents; data breaches; inaccuracies in call or message logs; or any other interruption, malfunction, disruption, or failure of the Services, REGARDLESS OF CAUSE.

3.3. SOLE AND EXCLUSIVE REMEDY; CAP ON LIABILITY: Your sole and exclusive remedy for any dissatisfaction with the Services is to discontinue use immediately. IN NO EVENT SHALL WEBSIMHOST'S TOTAL AGGREGATE LIABILITY TO YOU FOR ANY AND ALL CLAIMS ARISING FROM OR RELATED TO THESE TERMS OR THE SERVICES. UNDER NO CIRCUMSTANCES WILL WEBSIMHOST BE LIABLE FOR ANY INDIRECT, SPECIAL, PUNITIVE, INCIDENTAL, OR CONSEQUENTIAL DAMAGES, INCLUDING BUT NOT LIMITED TO LOST PROFITS, LOST REVENUE, LOST BUSINESS OPPORTUNITIES, LOST DATA, OR COSTS OF PROCUREMENT OF SUBSTITUTE GOODS OR SERVICES.

4. STRICTLY PROHIBITED USES AND UNACCEPTABLE ACTIVITIES
You covenant, represent, and warrant that You will NOT use the WebSimHost Services for any unlawful, fraudulent, abusive, deceptive, or unauthorized purpose. The following prohibitions are MATERIAL CONDITIONS of this Agreement, the breach of which constitutes an incurable default.

4.1. ABSOLUTE PROHIBITION ON FINANCIAL, GOVERNMENT, AND CRITICAL VERIFICATION: You are STRICTLY, CATEGORICALLY, AND ABSOLUTELY PROHIBITED from using the Services, including any provided virtual numbers, for the purpose of verification, authentication, two-factor authentication (2FA), account creation, password recovery, or transaction authorization with ANY of the following: - Financial Institutions: Banks, credit unions, savings associations, trust companies, or any depository institution. - Payment & Cryptocurrency Platforms: Payment processors (PayPal, Stripe, Square), digital wallets (Venmo, Cash App), cryptocurrency exchanges (Coinbase, Binance, Kraken), NFT marketplaces, or decentralized finance (DeFi) applications. - Government & Official Services: Government agencies, tax authorities, social security administrations, postal services, or any official identity verification service. - Social Media & Critical Accounts: Primary account verification for major social media platforms (Meta/Facebook, X/Twitter, Google, Apple ID) where the number could be used for account recovery. - Healthcare & Insurance: Health insurance portals, medical providers, or pharmacies requiring SMS verification. Any such use is a FUNDAMENTAL BREACH, resulting in immediate, permanent account termination and forfeiture of all funds.

4.2. STRICT BAN ON GEOGRAPHICAL IDENTITY MANIPULATION: The use of Virtual Private Networks (VPNs), proxy servers (including residential, mobile, or datacenter proxies), the Tor network, or any other technology, software, or method designed to disguise, obfuscate, falsify, or manipulate your true IP address, geolocation, or network point of origin is STRICTLY FORBIDDEN during account registration, login, top-up, or at ANY TIME during Service usage. WebSimHost employs continuous, sophisticated detection and monitoring systems. Any violation will result in immediate, permanent account termination without warning, notice, or refund.

4.3. PROHIBITION ON ILLEGAL, FRAUDULENT, AND ABUSIVE CONDUCT: You agree NOT to use the Services to engage in, facilitate, or promote any activity that violates applicable law in your jurisdiction or the jurisdiction where the Services are provided. This includes, but is not limited to: fraud; phishing; spamming (commercial or otherwise); harassment; stalking; threats; intimidation; hate speech; dissemination of malware; SIM-swapping attacks; spoofing; robocalling; infringement of intellectual property rights; impersonation; evading bans or suspensions on other platforms; or any activity that compromises the security, integrity, or availability of any network, system, or service.

5. UNILATERAL RIGHT TO SUSPEND, TERMINATE, AND FORFEIT FUNDS
5.1. WEBSIMHOST'S ABSOLUTE AND DISCRETIONARY RIGHT: WebSimHost reserves the sole, absolute, and unrestricted right to suspend, restrict, throttle, modify, or terminate Your access to the Services, in whole or in part, at any time, for any reason or no reason, with or without cause, and without prior notice or liability. This includes termination for: suspected violation of these Terms; unusual or abusive usage patterns; non-payment; requests from law enforcement or regulatory authorities; protecting the security, integrity, or operability of our systems or networks; or any activity we deem, in our sole judgment, to be harmful, risky, or undesirable.

5.2. IMMEDIATE EFFECT AND TOTAL FORFEITURE OF ALL FUNDS: Such suspension or termination shall be effective IMMEDIATELY upon action by WebSimHost. You HEREBY EXPLICITLY AGREE AND ACKNOWLEDGE that upon any suspension or termination of Your account or access to the Services—FOR ANY REASON—You shall PERMANENTLY AND IRREVOCABLY FORFEIT any and all account credits, prepaid balances, subscription fees, top-ups, or other monetary value residing in Your account. No prorated refunds, credits, reimbursements, or payouts will be issued under any circumstances. This forfeiture is an agreed-upon liquidated damage and not a penalty.

5.3. OPERATIONAL AND SECURITY-RELATED SUSPENSIONS: WebSimHost may suspend Services temporarily for scheduled maintenance, emergency security patches, system upgrades, or to mitigate operational threats (e.g., DDoS attacks) without prior notice and without such action constituting a breach of these Terms or incurring any liability.

6. NO REFUND POLICY – FINAL, NON-NEGOTIABLE, AND INTEGRAL TO AGREEMENT
ALL PAYMENTS MADE TO WEBSIMHOST ARE FINAL, NON-REFUNDABLE, AND NON-TRANSFERABLE. You expressly, knowingly, and irrevocably waive any right to claim a refund, rebate, credit, chargeback, or return of funds under ANY AND ALL CIRCUMSTANCES, including but not limited to: service dissatisfaction; partial or non-use of purchased credits or time; inability to use the Services for Your intended purpose (including failed verifications); account suspension or termination (whether by You or WebSimHost); changes to Service features or pricing; pricing errors; or Your violation of these Terms. By submitting payment, You acknowledge and agree that this no-refund policy is a fundamental, material basis of the commercial bargain between You and WebSimHost.

7. COMPLETE DISCLAIMER OF ALL WARRANTIES
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE WEBSIMHOST SERVICES AND ALL RELATED SOFTWARE, WEBSITES, AND DOCUMENTATION ARE PROVIDED "AS IS," "AS AVAILABLE," AND "WITH ALL FAULTS." WEBSIMHOST EXPLICITLY DISCLAIMS ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, SYSTEM INTEGRATION, QUIET ENJOYMENT, AND WARRANTIES ARISING FROM COURSE OF DEALING, USAGE, OR TRADE PRACTICE. NO ADVICE OR INFORMATION, ORAL OR WRITTEN, OBTAINED FROM WEBSIMHOST OR THROUGH THE SERVICES, WILL CREATE ANY WARRANTY NOT EXPRESSLY STATED HEREIN. SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF IMPLIED WARRANTIES, SO THE ABOVE EXCLUSIONS MAY NOT APPLY TO YOU IN WHOLE, BUT SHALL APPLY TO THE MAXIMUM EXTENT PERMITTED BY LAW.

8. LIMITATION OF LIABILITY – CUSTOMER'S EXPRESS ACKNOWLEDGMENT
IN NO EVENT SHALL WEBSIMHOST, ITS PARENT, SUBSIDIARIES, AFFILIATES, LICENSORS, SERVICE PROVIDERS, EMPLOYEES, AGENTS, OFFICERS, OR DIRECTORS BE LIABLE FOR ANY INDIRECT, SPECIAL, INCIDENTAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO DAMAGES FOR LOSS OF PROFITS, GOODWILL, BUSINESS REPUTATION, USE, DATA, OR OTHER INTANGIBLE LOSSES (EVEN IF WEBSIMHOST HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES), ARISING OUT OF OR IN CONNECTION WITH: (I) YOUR USE, OR INABILITY TO USE, THE SERVICES; (II) ANY UNAUTHORIZED ACCESS TO, USE OF, OR ALTERATION OF YOUR TRANSMISSIONS, DATA, OR ACCOUNT; (III) STATEMENTS, CONDUCT, OR CONTENT OF ANY THIRD PARTY ON OR RELATED TO THE SERVICES; OR (IV) ANY OTHER MATTER RELATING TO THE SERVICES. THESE LIMITATIONS APPLY REGARDLESS OF THE LEGAL THEORY UPON WHICH DAMAGES ARE CLAIMED (WHETHER IN CONTRACT, TORT, NEGLIGENCE, WARRANTY, STRICT LIABILITY, OR ANY OTHER THEORY) AND EVEN IF A REMEDY SET FORTH HEREIN IS FOUND TO HAVE FAILED OF ITS ESSENTIAL PURPOSE.

9. INDEMNIFICATION OBLIGATION
You agree to defend, indemnify, and hold harmless WebSimHost, its parent companies, subsidiaries, affiliates, officers, directors, employees, contractors, agents, licensors, and suppliers from and against any and all claims, demands, damages, obligations, losses, liabilities, costs, debts, fines, penalties, and expenses (including but not limited to reasonable attorneys' fees, expert witness fees, and court costs) arising from or related to: (i) Your use of and access to the Services; (ii) Your violation of any term of these Terms; (iii) Your violation of any third-party right, including any intellectual property, privacy, publicity, or contractual right; (iv) any claim that Your use of the Services caused damage, loss, or liability to a third party; or (v) Your violation of any applicable law, rule, or regulation. This indemnification obligation will survive the termination of these Terms and Your use of the Services. WebSimHost reserves the right, at its own expense, to assume the exclusive defense and control of any matter otherwise subject to indemnification by You, in which event You will cooperate fully with WebSimHost in asserting any available defenses.

10. MODIFICATION OF TERMS
WebSimHost reserves the unilateral right, at its sole discretion, to modify, amend, restate, supplement, or update these Terms at any time and for any reason. Such modifications will be effective immediately upon posting the revised Terms on the WebSimHost website or within the Service dashboard/application. The "Last Updated" date at the top of these Terms will be revised accordingly. It is Your sole responsibility to periodically review these Terms for changes. Your continued use of the Services following the posting of revised Terms means that You accept and agree to the changes. If You do not agree to the new terms, You must stop using the Services. No other modification, amendment, or waiver of any provision of these Terms will be effective unless in writing and signed by an authorized representative of WebSimHost.
